The Indictment
The Milosevic Hearing considered evidence against Slobodan Milosevic in relation to allegations of war crimes in Kosovo which are being investigated by the International Criminal Tribunal for the Former Yugoslavia. In summary, the indictment drawn up by the tribunal charges:

Slobodan Milosevic as President of the Federal Republic of Yugoslavia (FRY), Supreme Commander of the Yugoslav Army, President of the Supreme Defence Council and pursuant to his de facto authority with murder and with persecutions on political, racial or religious grounds in the context of an armed international conflict (a violation of the laws or customs of war under Article 3 of the statute) on the basis of superior criminal responsibility according to Article 7(3) of the statute. Article 7(3) states that 'the fact that any of the (criminal) acts (alleged) was committed by a subordinate does not relieve his superior of criminal responsibility if he knew or had reason to know that the subordinate was about to commit such acts or had done so and the superior failed to take the necessary and reasonable measures to prevent such acts or to punish the perpetrators thereof '. The crimes are alleged to have taken place between 1 January 1999 and late May 1999, and to have been carried out by the military forces and some police units of the FRY, the police force of Serbia and associated paramilitary units.
