91Èȱ¬ Survey Builder Extra Terms of Use

1. These Survey Builder Extra Terms of Use along with the 91Èȱ¬ Terms of Use [/usingthebbc/terms/] apply when you access and use 91Èȱ¬ Survey Builder, an experimental research tool created and owned by the 91Èȱ¬.

2. The tool can be used to create a human values survey and assess attitudes/values of individuals belonging to a certain interest group. You are welcome to test it, but keep in mind Survey Builder can only be used to create survey questions in a non-commercial research / experimental context and the tool must not be used to distribute the survey or to process any response to it. The tool is available ‘as-is’ and there are no warranties or support for it.
3. The tool can only be accessed by users authorised by the 91Èȱ¬ via a personal 91Èȱ¬ MakerBox platform account. The survey questions will be processed on the user’s personal device and not hosted by the 91Èȱ¬. If you want to keep your surveys, make sure that you save them on your personal device. The 91Èȱ¬ will have no responsibility if you lose any data for any reason whatsoever and the 91Èȱ¬ may make changes to Survey Builder, or delete or suspend parts of it without prior notification.
4. If you wish to delete your Survey Builder account and related data please send the 91Èȱ¬ Connected Studio MakerBox team an email to makerbox@bbc.co.uk.

5. If there is an inconsistency between parts of these Survey Builder Extra Terms of Use with parts of the 91Èȱ¬ Terms of Use [/usingthebbc/terms/], those parts of the Survey Builder Extra Terms of Use that are inconsistent override the 91Èȱ¬ Terms of Use.
Who owns the surveys that I create with Survey Builder?
6. You own the copyright that you create in your surveys, i.e. your work that is completely new and original. But your rights in / to your work / surveys are always subject to (i) these Extra Terms of Use and (ii) any pre-existing rights that the 91Èȱ¬ may have, such as the copyright in the Survey Builder and any 91Èȱ¬ formats. Survey Builder, including any associated pre-existing rights and improvements to the tool will always be owned by the 91Èȱ¬.

What are the rules for creating Surveys using Survey Builder ?
7. You have permission (a non-exclusive, personal licence) to test Survey Builder and create human values surveys with it. Do not share your user name and password with anyone else.
8. The 91Èȱ¬ won’t pay you for a survey you create with Survey Builder or any feedback that you provide to us.
9. Don’t use Survey Builder to create a survey in relation to the use of something that’s horrible or illegal and/or to create a survey consisting of questions that are rude. The 91Èȱ¬ Terms of Use for commenting and sharing also apply to surveys you create with Survey Builder (e.g. Don’t harm or offend other people...).
10. You must comply with data protection law. Make sure that any survey question you create doesn’t include personal details of any individuals, is only designed to collect anonymous / aggregated data and that you only invited others to take the survey after seeking an independent legal advice (e.g. to ensure that survey respondents have given informed consent).
11. Don’t use somebody else’s tools, data or content in / for your human values survey, unless you have got their permission. Getting such permission may involve you paying a fee.
12. Don’t use Survey Builder in any way that may bring the 91Èȱ¬ into disrepute or breaks the law.
13. You must not copy, adapt, reverse engineer, de-compile, disassemble or modify Survey Builder.
14. Don’t use 91Èȱ¬â€™s name or logo. You need to ask for separate permission to do that.
What will the 91Èȱ¬ do with my survey questions and research results?
15. The 91Èȱ¬ would be happy to review your survey questions / any results and can use these, and any feedback from you, for any purpose with no restrictions. The 91Èȱ¬ will own all the intellectual property rights in anything it creates or improves based on this activity.
If 91Èȱ¬ wishes to publish your research results (e.g. survey questions and/or results), we will confirm you are okay with it, but the 91Èȱ¬ has no obligation to publish anything that you create.
Can I send my human values survey questions to others?
16. Surveys may involve inviting participants to take part in a survey and processing their data. Such activities are usually subject to data protection law requirements. You should seek an independent legal advice before inviting others to take part in your surveys. You are welcome to use Survey Builder to create your survey questions, but keep in mind that the tool was created by the 91Èȱ¬ as an experimental research tool and is available ‘as-is’ and with no warranties or support for it. You are permitted to send others survey questions that you created using Survey Builder only if:
a. you don’t bundle questions from other sources (e.g. questions that you independently created or any questions created by another person).
b. your survey (including its subject matter and questions) is appropriate and not have the potential to bring the 91Èȱ¬ into disrepute, e.g. is in line with the 91Èȱ¬ Terms of Use / 91Èȱ¬â€™s Editorial Policy and complies with the law.
c. you do not use Survey Builder for commercial purposes including things like promoting products, services, websites or events, sales and any other activity aimed at generating revenues or making a profit.
d. the survey is not provided by you as a service and you don’t provide/offer survey questions/results to any person that has to pay a fee.
e. you do not embed the survey in any other website, product or service. Your surveys can only be used for testing purposes. The survey that you create can only be sent to a limited number of participants that agreed to take part in it.
f. you don’t send the survey questions or an invitation to take part in it as unsolicited (junk) mail to anyone. For example, you cannot send it to everyone on a mailing list unless they’ve given permission for you to send it to them.
g. you don’t publish the survey results other than in a non-commercial research context and without any personal data of survey respondents. E.g. you are permitted to publish your survey results in an academic paper or to present them at a professional conference.
h. you do not imply that your survey was created by, in collaborations with or on behalf of the 91Èȱ¬ or endorsed by the 91Èȱ¬. Remember that you cannot use the 91Èȱ¬â€™s name or logo and the words ‘Survey Builder’, without 91Èȱ¬â€™s written permission.
i. You inform each person you invite to take part in the survey, or to read any survey results, that you are fully responsible. You must not imply that the 91Èȱ¬ is responsible in any way whatsoever.
j. you do not use Survey Builder or any surveys to collect or share personal details or views of any person.
k. You must notify the MakerBox team (makerbox@bbc.co.uk) as soon as you become aware of any legal issue that may affect the 91Èȱ¬, such as data protection and intellectual property right infringements relating to Survey Builder or your human values survey. Please also get in touch if you are unsure.

17. The 91Èȱ¬ may stop your permission to use Survey Builder (including any survey created with it and your survey results) at any time if you breach any 91Èȱ¬ terms and/or for any legal, editorial and related reason at 91Èȱ¬â€™s sole discretion. If this happens you must immediately stop using Survey Builder and any surveys / survey results. This also includes an obligation to notify others who have been invited to take part in your survey, or received a copy of the survey results, that they must stop using them too.

The 91Èȱ¬ collects and handles personal data that you provide when requesting access to Survey Builder, when creating your Survey Builder account on 91Èȱ¬ MakerBox and when you give feedback on your experience. The 91Èȱ¬ will use your personal data to control access to Survey Builder. Your surveys, including the questions, any information that you use to create them and information of survey participants are stored and processed and controlled by you (e.g. on your personal device).
What will 91Èȱ¬ collect and how will we use it?
The 91Èȱ¬ may use your personal data for the purpose of ensuring authorised access to Survey Builder, responding to your queries about Survey Builder, collecting your feedback on Survey Builder and asking to review or publish your research results. The 91Èȱ¬ will be the data controller of personal data you provide to the 91Èȱ¬.
